Liability Waiver
By enrolling in the Seli Strength program, you agree to the terms of this waiver. Please read carefully before completing your enrollment.
Acknowledgment of Risk
Physical exercise involves an inherent risk of injury. BFR training, like all forms of exercise, carries risk when not performed correctly. I understand that these risks cannot be completely eliminated even when reasonable care is exercised. I acknowledge that I have been informed of the contraindications associated with BFR training and confirm that none of them apply to me, or that I have received physician clearance to proceed.
BFR Contraindications
BFR training is not appropriate for everyone. Do not participate in this program if any of the following apply to you:
Severe hypertension (untreated)
Active deep vein thrombosis (DVT)
Blood clotting disorders
Severe peripheral vascular disease
Pregnancy
Active lymphedema, infections, open wounds, or tumors in the affected limb (BFR may be used on other limbs for systemic benefits)
Do not participate if your doctor has advised against vigorous exercise. If you are recovering from serious illness, injury, or surgery, consult your physician and receive clearance before beginning this program.
Release of Liability
In consideration of being permitted to participate in the Seli Strength program, I voluntarily release Seli Strength Inc, its coaches, employees, contractors, and affiliates from any and all claims, demands, actions, or causes of action arising from or related to my participation, instruction, and/or supervision in the program, including but not limited to claims arising from the ordinary negligence of Seli Strength, its owners, coaches, contractors, employees, and agents; claims for personal injury, illness, products liability, property damage, or death, to the fullest extent permitted by applicable law.
Assumption of Personal Responsibility
I understand that coaches cannot observe every aspect of my performance through online instruction. I am solely responsible for monitoring my own condition, selecting appropriate resistance and cuff pressure, maintaining a safe exercise environment, and stopping exercise if I experience pain or concerning symptoms. I further represent that I have no medical condition that would make participation unsafe, or that I have consulted with and obtained clearance from my healthcare provider. I agree to follow program guidance, use appropriate weights, use equipment properly, follow pressure recommendations, and stop exercising and seek medical attention if I experience any warning signs during a session. I further agree to disclose to Seli Strength any changes to my medical or health condition.
Covenant Not to Sue
I agree not to initiate or maintain any lawsuit or legal proceeding against Seli Strength arising out of risks assumed under this Agreement, except to the extent prohibited by applicable law.
Indemnification
I agree to indemnify and hold harmless Seli Strength Inc. and its owners, coaches, employees, and contractors from any third-party claim, loss, or liability (including reasonable attorneys' fees) arising from my negligent or intentional conduct, my misuse of Program equipment, or my failure to follow the Program's instructions or safety guidelines. This provision does not require me to indemnify Seli Strength for claims resulting from its own gross negligence or willful misconduct.
Severability
If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.
Integration
This Agreement constitutes the entire agreement concerning the assumption of risk and release of liability.
Governing Law
This waiver is governed by the laws of the State of California. Any disputes arising under this waiver shall be resolved in the courts of San Mateo County, California.
Acknowledgement of Acceptance
☐ I have read and agree to the Liability Waiver, Assumption of Risk, and Release of Liability. I understand that by checking this box I am giving up certain legal rights, including the right to sue Seli Strength for claims arising from ordinary negligence to the fullest extent permitted by law.
